Definition of OwnershipIn Mexico like any where else in the world there is a legal way of doing a real estate transaction without any problems. In fact the legal system that was established by the federal government is fool proof even though it is very different from other countries. First of all in Mexico there is a restriction imposed on real estate transactions when a foreigner is involved as the buyer. Secondly in Mexico the legal system is based on Roman law doctrine and principals which are different from the legal system known as the Common Law which is used in the United States of America and Canada and most of the countries if not all that were colonized by England a long time ago. To be able to fully understand and explain the way the legal system provides to an investor a safe investment we must go back to basics. Example of "Real ownership": One buys a shirt and has receipt to prove he paid for it has the real ownership of the shirt and no one can claim any Rights on the shirt. in other words we can say that one has a "Real Right". Example of "No real ownership": One who purchases a real estate property located in a country where a constitutional disposition enables the nation to expropriate and / or where the laws permit the governmental authority to seize and sell to a third party a real estate property for the motive of unpaid property taxes. In other words ever since governments made laws to take away a real estate property under a specific law no one has "Real ownership" anymore; one only has a Right of "USUS" and "FRUCTUS" (uses and fruits) which is a "Personal right", nothing more nothing less. In real estate matters in Mexico we have the same Rights (personal Rights and real Rights) for everyone except that the authority, as the law stands, can not sell the property to a third party in the event that the property taxes are not paid.
