Independent Real Estate closing
During a real estate purchase and sale it is said that human emotions are present on both side of the table and when emotions are part of any transaction mistakes can be easily made thus the need to have an independent third party to supervise the process and this is what we at CAN-AM-MEX do in the following manner: 1. - Review of the Offer of Purchase & Sale contract. In the event that the client wants us to draft an offer we can do it but this 2. - Trust account service for the buyer. 3.- Examination of all entries at the Registry office, in the event of problems regarding a past transaction we provide a letter to the buyer advising that the situation has to be corrected before the transaction is completed. In the case of "Ejido" land (Land own by a community) or land that once was part of an "Ejido" a special procedure is taken to insure clear “title” to the buyer. 4. - Drafting of a certificate stating that there is no defects in the "title chain" for the past 51 years. 5. - Examination of all certificates issued regarding no leans, no balance of water bill, and property taxes. 6. -Contact with financial institution regarding federal Secretary of External Relationship (SRE) permit, verification of permit for errors and / or omissions. 7. - Keep contact with the Broker or agent or seller to make sure that all the documents that they have to supply are supplied to the “Notario Publico”. 8. - Verify all the documents that are supplied by the Seller to make sure there are no errors or even false statements or receipts. 9. - Verify all documents drafted by the “Notario Publico” for errors or omissions. 10. - Supply a translator at the signing of the documents in front of the “Notario Publico”; 12. - Verify at the Registry office prior to signing session to make sure no mortgages or other leans were registered against the property since the first visit. 13. - If required representation of buyers at signing session or translator function at said session. 14. - Verification that the documents (Escritura or FTD contract) is properly registered at Catastro (land office and Public 15. - We provide progress reports at every event to the client. 16. - We use computerized systems to optimize our services. B) In the event that the client is a seller we make sure that no capital gain taxes are applied at the sale of a dwelling if all conditions required by law are respected. 1.- Private property: In case the property is to be purchased by foreigner(s) it must be purchased under a FTD contract (Fideicomiso Traslado de Dominio contract), this been said we provide complete legal supervision of the process with the financial institution which will administer the contract and legally conserve the property and revise all the documents written by the “Notario Publico” (contract lawyer) to make sure no errors are present in the documents. We provide translation service at the signature session in front of said legal professional and do a follow up on the registration of the documents. Professional fees for the above described closing service are set at a standard 1200.00 US$; plus expenses such as photocopies, professional evaluation, certificates by different governmental agencies and travel all of which are justified by providing proper receipts. In the case of a formal partnership the property can be purchased via an “Escritura” which provide real rights to the partnership. In the event that the purchase is done under the names of the buyers and if the buyers do not hold the Mexican nationality the purchase must be made via a FTD contract. Please note that we provide the same services as for the closing for a dwelling and we can and should provide all necessary contracts and registrations at the different government institutions including tax dept.
